The agreement between you and Happita when you shop with us — what you can expect from us, and what we ask of you.

Introduction & agreement to these terms

These terms govern your use of the Happita website and online store. By browsing the site, creating an account or placing an order, you agree to them. If you do not agree, please do not use the store.

“We”, “us” and “Happita” mean Happita, of 100 Queen St W, Toronto, ON M5H 2N2, Canada. “You” means the person using the site or placing an order.

We may update these terms as the store changes or the law does. The version published here at the moment you place an order is the one that applies to that order — changing the terms afterwards does not change the deal you already made. The date at the top of the page always shows the current version.

Our Privacy Policy explains how we handle your personal information and forms part of these terms.

Online store terms & your account

To use this store you must be at least the age of majority where you live, or have the consent of a parent or guardian. You may not use our products for any illegal purpose, or breach any law in your jurisdiction while using the site.

If you create an account:

  • Give us accurate, current details, and keep them up to date — we rely on them to deliver your order and to reach you about it.
  • Keep your password confidential. You are responsible for what happens under your account, so tell us at once if you think someone else has access to it.
  • One person, one account. Do not share it, sell it, or let anyone else order through it.

We may suspend or close an account that is used fraudulently, abusively, or in breach of these terms. Where we do, we will tell you why unless we are legally prevented from doing so.

Products, pricing and availability

We describe and photograph every product as accurately as we can, but we cannot promise a listing is entirely free of error. Colours in particular depend on your screen, and a garment may look slightly different in person.

  • Availability. Stock changes constantly and much of what we carry is limited. Listing a product is not a promise that we can supply it — if an item sells out after you order, we will tell you and refund that item in full.
  • Pricing. Prices are shown in the currency displayed at checkout and may change without notice. The price that applies is the one shown when you place your order.
  • Errors. If a product is listed at an obviously incorrect price and you could reasonably have realised it was a mistake, we may cancel the order and refund you in full rather than supply at that price. We will always contact you first.
  • Taxes and duties. Applicable taxes are calculated at checkout. For deliveries outside Canada, any import duties or customs charges are yours to pay.

We may change or discontinue any product at any time, and may limit the quantity of any item we sell to one person or household.

Orders, payment and delivery

Order acceptance. Placing an order is an offer to buy. Our confirmation email acknowledges that we received it; the contract between us is formed when we dispatch the goods. We may decline an order — for example where an item is unavailable, where we could not take payment, or where we suspect fraud — and if we do, we will refund anything you have paid.

Payment. Payment is taken at checkout through our payment provider over an encrypted connection. Your full card number never reaches our servers. You confirm that the payment method you use is yours, or that you are authorised to use it.

Delivery. We dispatch as quickly as we can and will give you an estimated delivery window at checkout. Estimates are estimates: carriers, weather and customs are outside our control, so a date given is not guaranteed. Risk in the goods passes to you on delivery.

  • Check your delivery address carefully — we cannot redirect a parcel once it has been dispatched.
  • If a parcel arrives damaged, tell us within 48 hours with a photograph and we will put it right.
  • If a parcel does not arrive within a reasonable time of the estimate, contact us and we will trace it with the carrier.

Returns, refunds and exchanges

If something is not right, you may return it within 30 days of delivery.

  • Condition. Items must be unworn and unwashed, in their original condition with any tags and packaging still attached.
  • What cannot be returned. For hygiene reasons we cannot accept returns of underwear, swimwear, pierced jewellery or opened cosmetics unless they are faulty. Items marked final sale are not returnable.
  • How to start a return. Email contact@happita.com with your order number and we will send you instructions.
  • Refunds. Once we receive and check the item we will refund it to your original payment method within 10 working days. How quickly it appears then depends on your bank.
  • Return postage. Return postage is yours to pay unless the item is faulty, damaged or not what you ordered — in which case we cover it.
  • Exchanges. Because stock moves quickly, the fastest way to exchange is to return the item for a refund and place a new order for the one you want.

None of this affects your statutory rights in respect of faulty or misdescribed goods, which stand regardless of anything in these terms.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute. If any part of these terms is found unenforceable, the rest continues to apply.
